Capital Care Network of Toledo v. State of Ohio Department of Health

Another abortion case is headed to the state’s high court, Capital Care Network of Toledo v. State of Ohio Department of Health and DOCKET

The Ohio Supreme Court has agreed to hear the appeal of two lower court decisions that found restrictions imposed on Capital Care Network of Toledo were unconstitutional.

The case stems from a 2014 Department of Health decision to shutter the city’s last abortion clinic after it determined a patient transfer agreement it had inked with an Ann Arbor hospital ran afoul of state law because the facility was not “local.”

However, both the Lucas County Common Pleas Court and the Sixth District Court of Appeals sided with the clinic, which has remained open.
